Article 1

Introduction for Terms & Condition

The following Terms and Conditions shall apply to parties using the site service (hereinafter “the service”), or purchasing items from official EC site for foreign travelers "ドン・キホーテ" (hereinafter “the Site”), a website administered by Don Quijote Co., Ltd. (hereinafter "the Company").

Article 2

Privacy Policy

The Company, with regard to your personal information, shall be handling base on the "personal information protection policy (hereinafter “Privacy Policy”) published on the official EC site "ドン・キホーテ”.

Article 3

Membership Registration
  1. The customers are required to register to correctly register the correct information in order to use the service or purchase items (member registration).
  2. It is required of the customer wishing to register membership to agree to the contents of these Terms & Conditions and accurately provide your name and address information beforehand in order to be qualified for a registered member (hereinafter “member”). Membership ID is entitled to those registration procedures performed by the customer himself to become a membership, registration by proxy shall not be accepted. Members are limited to customers who are adult (over 20 years old). Guests under 20 years of age, only if there is involvement of the legal representative, shall be accepted for the service.
  3. The company, if applicable to any of the following statements, customers shall not be approved for registration.
    1. Those whose accounts were suspended in the past due to violation of the terms related to the service.
    2. Those identified for registering with false information.
    3. Those with the history of violation related to the service such as delinquency, over-storing of items, receipt refusal, returns and exchanges for no valid reason.
    4. Those identified in terms of prohibitions and conducting of such.
    5. Other aspects determined inadequate under registration policy of the company.
  4. The members are responsible for updating or changing registered information based on the terms and conditions, if in valid reason the registered information must be modified. The company is not responsible of damages incurred as a result for negligence of necessary modification.

Article 4

Member ID & password
  • 1.You are considered to have agreed to bear responsibility for all actions taken using your ID and password.
  • 2.Please take care to prevent discovery and misuse of your member ID and password by a third party.

Article 5

Service cancellation & Suspension
The Company has the right to suspend or terminate membership at any time if you perform any of the following.
  1. Those who do not comply with the Terms and Conditions.
  2. Those who have been a nuisance or caused interference or damage to other customers or the Company, or committed any fraudulent acts.
  3. Those were identified for registering with false information.
  4. Other aspects were identified inadequate under the company policy.

Article 6

Account Termination

Members wishing to terminate the site service, the member himself is required to process for termination based on the procedure instructed in the terms and condition on the site.

Article 7

Upon using the service
Members, upon agreement to comply with the following terms and conditions, shall be allowed to use our service provided.

Prohibited

Members, upon using the service, shall not be conducting the following acts. By any means, the members identified for conducting following acts and inflicted damages to the company or third parties, the company shall be able to issue compensation for damages inflicted with respect to the member. In addition, the company has the right to terminate the membership of the member.

  1. Use unauthorized Member ID and password
  2. Transfer or loan Member ID and password to a third party
  3. Registration of false information
  4. Conducting falsification, modification or transferring harmful software upon access to the company website, and inflicting damages to or prevents our service operation.
  5. Infringement of copyright and intellectual property rights of the company, third party or the other customer
  6. Act of privacy infringement of the company, third party or of the other customers.
  7. Act of defamation, intimidation, and slandering to the company, third party and or the other customers.
  8. Causing disadvantage and discomfort to a third party
  9. Act of contrary to public order and morals
  10. Conducting actions that lead to crime
  11. Pretending to be a third party or organization using false E-mail address.
  12. Misleading of credit card or other information
  13. Other act of violation related to the law and regulation act.

Copyright

The copyright, and trademark rights related to designs and images uploaded on the site are a property of the company or of the other rights holders. Should there be an act of violation suspected, customers are responsible of solving issues in respect to the act without inflicting damages or inconvenience to the company.

Server cost

Customers are responsible for bearing the cost incurred upon viewing of the site, using of the service or sending or reception of the emails.

Order & Delivery
  • When placing an order for the first time, please agree to the contents of these Terms & Conditions and accurately provide your name and address information beforehand.
  • It is required of the customer wishing to register to correctly register the correct information in order for the Company to issue a member ID and password (member registration).
  • Please consult with the “Countries and Regions We Ship To” and “Shipping and Handling Charges” pages for more information regarding service in your area.
  • Please take care to prevent discovery and misuse of your member ID and password by a third party. You are considered to have agreed to bear responsibility for all actions taken using your ID and password.
  • Regardless of the payment method and delivery method member has chosen, property rights relating to the goods passes to the member after the goods were dispatched. If you would like to have the order re-shipped, then you should pay the actual, full price of the shipping costs, etc. PO Box is not accepted as a registered destination.
  • The maximum purchase limit per order is 200,000 yen per order. This limit or 200,000 yen only includes the total item amount and does not include shipping & handling fees and option fee.
  • There may be cases where there is a stock shortage of one or all items at the time of checkout process. Please kindly understand that the stock shortage may not allow customers to process check out.
  • The contract between the customer and the Company shall be established at the time that the Company ships the relevant item(s) to the customer. The sending of an Order Confirmation email by the Company is for the purpose of confirming the contents of your application to enter into a contract with the Company, and does not mean that the Company has approved your application to enter into said contract.
  • Even after sending the Order Confirmation email, due to there being a difference between the stock status displayed on Company's site and actual stock, there may be cases where there is a stock shortage of one or all items. Furthermore, the Company's stock status differs from the suppliers'. Please kindly understand that there are also cases where the same item is in stock at a supplier and out of stock at the Company.
  • In the event that one or more items ordered as part of an order are out of stock, the equivalent cost of the out-of-stock items will be deducted from the settlement amount and the order will be shipped without prior notification. Additionally, even if the item comes into stock after the order has shipped, the Company is unable to ship the item as a supplement to your previous order. Please make a new order for the item. Order contents (such as size, color, or quantity) and the shipping address information cannot be changed once the order has been placed.
  • Orders cannot be cancelled or changed in any way once they have been submitted.
  • Although your order shall be shipped within 9 days from the day it was placed, depending on the contents of the order, the condition of stocks, and the volume of orders, there may be instances where shipment of the order is delayed.
  • You should investigate the rules and regulations regarding importing into your country, including goods restricted for import, before placing an order. In the unlikely event that an ordered item is not allowed for import into your country or is subject to tax due to its high value, the Company cannot accept responsibility for the item. The Company cannot provide you any refunds or exchanges for the item or cost of delivery.
  • The Company reserves the right to combine multiple orders from the same customer, and ship them together as one unit. Even in the event that this results in shipping and handling fees being levied multiple times, the Company will not refund them.
  • The company will ship your order via Express Mail Service (EMS) or International Parcel Post. No matter the country or region, you may not choose the shipping service.
  • The Company has the right to cancel or terminate your orders at any time if you perform act of violation stated in the terms and conditions.

Shipping fee

Shipping and handling charges are set based on the total amount of ordered merchandise and those charges include the Express Mail Service (EMS) or international courier postage, domestic courier service charge etc., and insurance fees, etc.
They should be paid together with the total amount of the ordered merchandise. Certain items are charged "extra charges for special shipping". Each item is charged a "extra charge for a special shipping" in addition to the shipping charge and the purchase amount.
In the event that you refuse to accept the delivery of an order, or if an order is returned to the Company after the retention period at the post office has passed after failed delivery attempts, the cost of returning the item to the Company will be deducted from the cost of the items when making the refund, and will not be returned to you. Further, if the cost of returning the item to the Company is more than the value of the items, you must pay that difference to the Company.

Payment

The amount charged to you will be the total sum of the merchandise plus the shipping & handling fee and special shipping fee.
For more details regarding payment, please contact directly your credit card company, UnionPay company. In the event of a credit card order, please use a credit card that is in your own name.
If you use a credit card that is not in your name, the Company may refuse your order(s) without prior notice. Credit card payment will be made in Japanese Yen.
Method of Alipay、Wechat payment etc. shall be based on the terms and conditions of those companies. Settlements will be made in Japanese Yen.

Customs Duties and Export Certificates

Orders may be subject to import tax, value tax, customs handling fees, and/or delivery fees in some countries or regions. In this case, you (or the recipient if the merchandise is shipped to someone other than you) should be responsible for the payment of any such taxes or fees.In the event that the delivery of an order is delayed due to complications or processing at customs, the Company bears no responsibility for this situation. We do not issue certificates of origin, export visas for export verification, etc for delivered items.

Returns & Exchanges

For exchanges and returns, please be sure to contact "ドン・キホーテ" via email or fax within 14 days of item receipt regarding the details of the return item. After contacting us, please return only the items we approve (within 7 days of approval). We will not accept a return if you contact us after 14 days or not sent the item back with no contact at all.

Returns at the Company Fault
  1. The merchandise is different from what you ordered (wrong shipment).
  2. The merchandise is defective.
  3. The merchandise is damaged.

The Company will reimburse you for shipping costs incurred.

In the case of "At the Convenience of the Customer" Should an item not be to your liking (because you wish to change the size, color, pattern or change from a plate to cup etc.), the return shipping shall be paid by the customer. Also, we will not be able to accept your return in the following cases.
  1. You did not inform us about the return/exchange within 14 days of receiving the item
  2. Food item
  3. Items that have been used
  4. Order-made items (items manufacture after being order, e.g. a hanko)
  5. Engraved items
  6. Cosmetics,hygiene products where the package has been opened
  7. Items without a case or packaging (bag, etc)
  8. Items that have been altered and cleaned
  9. Items that you have soiled or damaged (incl. cosmetics, fragrances, odors)
  10. Items with the tag removed
  11. Items that have been warped by test trying on
  12. SALE items, outlet items, items marked with "no return/exchange" on the item page

Exchange in case of the Company Fault
  1. The merchandise is different from what you ordered (wrong shipment).
  2. The merchandise is defective.
  3. The merchandise is damaged.

Please inform the Company in advance if you wish to make an exchange. If the item(s) to be exchanged are out of stock or have been discontinued, you will be given a full refund for the merchandise.

Exchange at the Convenience of the Customer
  • If you are not satisfied with the items (because they do not fit or you do not like the color or print), the return will not be accepted. If you wish to exchange an item, we will send your new item after we have received your return.
  • Merchandise must be returned, with a “Returns and Exchanges” form, by Express Mail Service (EMS) or by airmail. Please do not send your return by surface mail, economy air (SAL), DHL, FedEx, UPS, or any other private international mail carrier. If the return is made through any method other than EMS or airmail it will not be accepted, and you will not receive a refund on the merchandise.
  • In the case of “Circumstances Arising with the Company”, you must pay in advance for shipping charges. Collect/Cash on Delivery (COD) shipments will not be accepted.
  • As soon as we confirm the arrival of a return item at the Company's address, we will send the exchange item or provide a refund. Should the returned item package not also include an Exchanges & Returns form, this may lead to processing delays. Methods of refund (merchandise and shipping costs) for the customer will be processed via following.
  • Refund through the credit card, Alipay account (after facilitated), or Wechat (after facilitated) that was used to purchase the merchandise.
  • The merchandise or shipping refund will be made through the credit card company, or Alipay account or Wechat that was used to purchase the merchandise.
  • In the event of a refund through a credit card, Alipay or Wechat, exchange rates applied to the amount billed for the merchandise and shipping and handling charges may differ from those at refund. Thus, there may be differences in the total amount refunded due to exchange rate differences. Also, please note that in the event of a credit card refund, depending on the different monthly deadlines of processing and pay dates, it may take as long as 2 months for the refund to process; for PayPal and Alipay, it may take from a few days, to the maximum of 10 days for the refund to finish processing.
  • Regardless of circumstances, Returns and Exchanges will only be accepted once per order.

Site Management

Disclaimer
  1. The Company, will not guarantee customers that this service is compatible with the specific purpose of our customers, also for those to have a function, product value and usefulness, accuracy, and the like to expect.
  2. The Company, except for the case where the Company is to blame, for damage inflicted to customers due to this service will not be responsible.
  3. Damages inflicted due to the service updates without notice will not be responsible of the company.
  4. The Company, for damages caused by defects in products that are sold through this service, and bear in the extent permitted by the Terms and Japanese laws and regulations, other liability shall not be responsible.
  5. The Company, if destination is unknown, shall be exempted contacting the information that have been registered to deliver the goods.

Article 10

Service Termination
  1. 1. At the time of following circumstances, the company has right to suspend, Release or Terminate a part of the site without prior notice to customers.
    1. The site conduct maintenance and system inspection regularly or urgently to update.
    2. The site cannot be operated due to inflicted natural disasters, power outage, or fire.
    3. The first Type I telecommunications business is not provided.
    4. Unauthorized access from the third party, or in case of a computer virus led the difficulty for system operation.
    5. Requested upon the basis of substantial evidence from government agencies and judicial institutions.
    6. The company determines that the publishing of the site is difficult due to unforeseen circumstances or technical issue.

Links
The company, if the third party provides a link to this site, or site provided outside of our management, will not be responsible of. Also, the company is not responsible for damages incurred due to the contents provided by the third party. Links to individual pages, there may be a possibility that the link will be lost without prior notice due to the site structure and server configuration of the third party.

Article 12

Liability
  1. The Company is not responsible of damages inflicted to customers and the third party as a result of site update, suspension or termination.
  2. The Company is not responsible of damages to the other customers and third party in respect to the member by using the service.
  3. The Company is not responsible for the damages inflicted to the customers as a result of computer virus infection or other harmful software when using the service.
  4. The Company will not guarantee the service environment and operation on equipment customers used for the service.

Article 13

Subcontracting

The Company, the provisions of our company (the "subcontractor") with respect to, and shall be able to outsource some or all of the business of maintenance and operation, etc.

Article 14

Contract Transfer

1. Members are not permitted to transfer rights or obligations related to the service to the third party without written consent of the Company.
2. The Company has rights to transfer business contract, rights and obligations related to the service to alienee. Upon transfer, members shall be agreed in advance as per Terms and Conditions.

Article 15

Trademark

Trademark "ドン・キホーテ" which is posted on the site, along with the name and products logo, etc, are the registered trademark of the Company or its affiliates. Other product names and company names are the registered trademarks or business names of others. Before using our registered trademark, you are required to have prior written consent from the Company.

Article 16

Exclusive agreement jurisdictional court

Any problems that may arise in respect to the Terms & Conditions will be subject to the first trial at the exclusive jurisdiction of the Tokyo District Court in Japan under relevant Japanese law.

Article 17

Change of Terms

The Company reserves the right to amend these Terms and Conditions as necessary without prior notice for customers. Customers, those who had accessed the site or used the service after the revised terms and conditions was published on the site are considered agreed upon revised terms and conditions. Even if a part of these Terms and Conditions is deemed to be improper or invalid, these Terms and Conditions are severable, and there will be no effect on the efficacy of other parts of these Terms and Conditions.

Article 18

Governing Law

With respect to use of the Site, Japanese law is considered to apply in full, and any problems that may arise between you and the Company will be subject under relevant Japanese law.
It should be noted that in case of when there is a discrepancy between the privacy policy stated in Japanese and the other languages, policy stated in Japanese will be applied and prioritized.

This Terms & Condition is in effect starting from October 1, 2016.
